Verità, giudizio penale e formula BARD

Come il diritto penale è inconciliabile con il nihilismo, la giustizia penale non tollera qualsiasi declinazione della pseudo-verità. Nondimeno, la verità giudiziale è la verità “nel” / “del” pro-cesso, è “una” verità tra verità, non “la” verità che non ammette dubbi, errori o alternative. La verità processuale è “relativa”, sotto un duplice punto di vista; il primo è il rapporto tra il fenomeno oggetto dell’accusa e il relativo accertamento processuale; l’altro è quello della relazione tra que-sta verità e la verità e “del” processo. La prima è conoscenza e può essere indagata al di là di ogni dubbio (BAD), la seconda è decisione e deve essere affermata nei limiti della formula BARD. La relazione tra dubbio, affermazione di colpevolezza e assoluzione è sicuramente asimmetrica. La “verità vera” regge ogni conclusione del giudizio; se, invece, non è BARD la verità “del” pro-cesso può condurre solo all’assoluzione.

Just as criminal law is irreconcilable with nihilism, criminal justice does not tolerate pseudo-truth. Nonetheless, Judicial truth is the truth “in” / “of” the trial, it is “a” truth between truth, not “the” truth that admits no doubts, errors or alternatives. The Judicial truth is “relative”, from a double point of view; the first is the relationship between the criminal charge and the evidences; the other is the relationship between this truth and the truth and “of” the judgement. The first is knowledge and can be investigated beyond all doubt (BAD), the second is decision and must be recognized within the limits of the BARD formula. But the relationship between doubt, guilty and acquittal is clearly asymmetrical. The “true truth”, the BARD truth, holds up every judgement; the not BARD truth can only lead to acquittal.
