Agricultural supply contracts are regulated in Italy by Decree n. 102/2005, under the frame of collective agreements. Conversely, contracts not included in this legislation are still submitted to general rules of civil law. Recently, for transparency reasons, Art 62 of Law 27/2012 introduced special rules concerning sale of agricultural and food products. As consequence, it is now compulsory to include, in writing contracts, some elements of the transaction: duration of the contract, amount and characteristics of goods, price, way of delivery and payment. These rules apply also to agricultural supply contracts concluded as enforcement of the framework agreement, regulated by Decree n. 102/2005. Nevertheless, to have an effect on individual contracts, framework agreements have to modify their contents, including all the elements now provided by law.
