La sentenza n. 278 del 2019 della Corte costituzionale ribadisce quanto già statuito nella (di poco) precedente sentenza n. 141 del 2019 con riferimento all’infondatezza dei dubbi di legittimità costituzionale sui reati paralleli alla prostituzione previsti dalla legge Merlin, specie se declinata nella sua variante «volontaria e consapevole». La decisione n. 278 del 2019 offre lo spunto per tornare a riflettere su alcuni argomenti utilizzati dalla Corte costituzionale che hanno incontrato diverse critiche della dottrina che si è occupata di esaminare il suo immediato precedente. This essay examines the content of the judgement n. 278/2019 of the Constitutional Court that follows the judgement n. 141/2019. It excludes that the exercise of voluntary and conscious prostitution is a form of expression of sexual freedom and has the nature of fundamental right ex art. 2 Cost. Consequently, it can be excluded that forms of help and tolerance of prostitution constitute forms of facilitating the exercise of a fundamental right and, therefore, that it is unconstitutional to consider them a crime. The judgment n. 278/2019 offers the opportunity to return to reflect on some topics used by the Constitutional Court that have met with some criticisms of the doctrine.
