La Costa Rica è uno dei pochi Paesi smilitarizzati al mondo; è una democrazia ispirata al principio del pacifismo in una regione travagliata ed espressione di una delle tradizioni costituzionali più accreditate al mondo. Tale tradizione è maturata con il contributo fondamentale prestato dal Giudiziario e, in particolare, dalla Sala constitucional della Corte suprema, istituita nel 1989. Il saggio si propone di esaminare la giurisprudenza della Sala in ordine a forma di governo e garanzia dei diritti.

Abstract
Costa Rica is one of the few developed countries in the world to be completely demilitarized. The country has always been considered the peaceful exception in the violent Central American region and one of the most respected constitutional traditions in the world.
