L’ACCESSO E L’INCIDENTALITÀ

This paper deals with verifying how the incidental judgment of constitutionality, by its hybrid nature, is susceptible to oscillating motions also due to the nature of the Constitutional Court. Indeed, it can significantly influence the access and the incidentalità of the constitutional judgment. The reasons can be different and mainly derive from the way in which it interacts with society or with institutional subjects.

Il presente lavoro si occupa di verificare come il giudizio incidentale di costituzionalità, per sua natura ibrido, sia suscettibile di moti oscillatori anche a causa della natura della Corte costituzionale. Essa, infatti, può influenzare in maniera significativa l’accesso e l’incidentalità del giudizio costituzionale. Le ragioni possono essere diverse e derivano prevalentemente dal modo in cui essa interagisce con la società o con gli soggetti istituzionali.
