PSI XIV 1449 Ulpianus 32 ad edictum

Arangio-Ruiz in the XIV vol. of Papiri Greci e Latini published a pergameneous fragment and assumed that the two short latin pieces, contained on the recto and verso, correspond respectively with two passages of the book 32 ad ed. of Ulpian: in particular, the recto (ll.1-9), would correspond with Ulp. 32 ad ed. D. 19.2.13.4, whereas the passage on the verso with Ulp. 32 ad ed. D. 19.2.15.1-2. Nevertheless, a synoptic comparison between the first 9 lines of the recto and D. 19.2.13.4 points out important differences, such as to exclude a direct relation between the two readings. The second part of the passage on the recto (ll. 10 ss.) does'nt find, instead, match in the Digesta, perhaps because there was examined a case already discussed in another seat, in a wider-ranging debate about actio ex locato. At last, the little differences that are noted between the passage on the verso and D. 19.2.15.1-2 derive from the trend, typical of the late age, to abridge the text of the classic authors, generally without obscuring the meaning.

Arangio-Ruiz nel XIV volume dei Papiri Greci e Latini pubblicava un frammento pergamenaceo e riteneva che i due brevi brani latini contenuti sul recto e sul verso corrispondessero a due passaggi del libro 32 ad ed. di Ulpiano: in particolare, il recto, dal rigo 1 al rigo 9, corrisponderebbe a Ulp. 32 ad ed. D.19.2.13.4, mentre il brano sul verso a Ulp. 32 ad ed. D. 19.2.15.1-2. Il confronto sinottico tra le prime 9 linee del recto e D. 19.2.13.4 evidenzia, tuttavia, delle differenze significative, tali da far escludere un rapporto diretto fra le due letture. La seconda parte del passo sul recto (ll. 10 ss.) non trova, invece, riscontro nei Digesta, forse perché si prendeva in esame una fattispecie già analizzata in altra sede all'interno di un discorso più ampio in tema di actio ex locato. Le poche differenze, infine, che si notano tra il passo riportato nel verso e quello conservato da D. 19.2.15.1 fine-2 inizio, derivano dalla tendenza, propria di età tarda, ad abbreviare il testo dei classici, in genere senza oscurarne il senso.
