La libertà di associazione tra tutela multilivello dei diritti e limiti imposti dalla sicurezza interna ed internazionale

The paper, starting from the reconstruction of the origin and the main lineages of the freedom of Association, aims to verify whether the implementation through legislation and judicial interpretation have proved to be respectful of the regime constitutionally assigned to the right of Association, particulary with regard to the regulation of limits to cases in which the social projection of the individual manifests itself. Examining constitutional, evolutionarily interpreted in the light of the ECHR and of the EU Charter on institutional interactions, will be assessment of the impact explained on this fundamental freedom from emergency laws, with particular regard to those issued since 2001 as parte of measures to combat international terrorism.
