La vicenda del gasdotto Trans Adriatic Pipeline (TAP) nel quadro della difficile implementazione della leale collaborazione intersoggettiva nell'ordinamento italiano

The present work starts from a reconstruction of the constitutional and legislative framework about the Trans Adriatic Pipeline (TAP) gas pipeline, functional to understand the numerous judicial disputes concerning this infrastructure, repeatedly brought to the attention of administrative judges and, lastly, also of the Consulta. There is substantial circumvention of the fundamental principle of loyal collaboration between the State and the regions, confirming the difficulty of achieving responsible and coordinated governance in strategic sectors such as energy, whose effective development also implies the consideration of the duties of economic and social solidarity on each Region, in the face of ultraregional determinations.
