The coordination between lex concursus and law applicable to acts detrimental to creditors triggers one of the main problems in the interpretation of Regulation (EC) no. 1346/2000 on insolvency proceedings, which has been replaced by Regulation (EU) 2015/848. This paper deals with such problems and offer some solutions having regard to the recent ECJ’s case-law, particularly that concerning the action to set aside.
