The essay deals with the constitutional and political development of the EU since the Maastricht Treaty and the failure of a EU Constitution. It suggests that the Maastricht Treaty introduced a constitutional setting that represented a break with the previous path of Europan Communities. The unsolved constitutional issue leaves the EU with a dilemma between a return to nationalism at the periphery and the deepening of social and political integration which would put into question the present liberal trust into free market.
