In a work of 1977 entitled "Dalla struttura alla funzione" [From structure to function]], Norberto Bobbio showed how theory in the twentìeth century divided itself mainly basing on the value of function in the concept of law. Hence, for example, the division between "Reine Rechtslehre" by Kelsen (1934, 1960) and "The Concept of Law" by Hart. The purpose of the essay is not only to resume this fundamental question, but also to do so within Kelsen' Wiener rechtstheoretische Schule of which Herbert Schambeck is an important heir.
