La politica giudiziaria del fascismo italiano nella giurisprudenza del Tribunale speciale per la difesa dello Stato (1926-1943)

Through the examination of the preliminary orders and judgments issued by the Special Court for the defense of the State, the essay examines the legal policy put in place by the Italian fascist regime between 1926 and 1943. In particular it distinguishes three distinct phases: the first, related to the 1920s, facing annihilation of illegal organizations and preventing attacks on Mussolini; the second, inaugurated since the 1930s, directed to ensure the stability of the regime adequately hitting any outbreak of revolt; the third, typical of the war years, aimed at curbing the opposition to the war.

Attraverso la disamina delle ordinanze istruttorie e delle sentenze emanate dal Tribunale speciale per la difesa dello stato, il saggio esamina la politica giudiziaria posta in essere dal regime fascista durante il ventennio. In particolare vengono distinte tre fasi:la prima, propria degli anni Venti, rivolta all’annientamento delle organizzazioni clandestine e della prevenzione degli attentati al duce; la seconda,inaugurata a partire dagli anni Trenta, diretta a garantire la stabilità del regime colpendo adeguatamente qualunque focolaio di rivolta; la terza, relativa agli anni della guerra, indirizzata a frenare l’opposizione alla guerra.
