L'evoluzione dei modelli familiari: dal principio di autorità alla tutela delle libertà personali

Nel novero delle formazioni sociali, fin dai tempi più antichi, la famiglia ha assunto la fisionomia di gruppo sociale organico e peculiare, avente la funzione primaria di soddisfacimento dei bisogni dei propri membri e di loro sostentamento e tutela. In virtù dei mutamenti sociali, alla tradizionale configurazione della famiglia apicale, fondata sul principio di autorità,nel tempo, si sono affiancati altri modelli di aggregati familiari, ispirati al principio di libertà. Nella visione della famiglia, pertanto, sotto la spinta dei tempi, è mutata la struttura del potere, che, da monocratico, si è trasformato in potere diarchico, quando addirittura non pluralistico. In questo trapasso, è risultata decisiva l’opera della Corte costituzionale, che ha tentato di adeguare le norme del codice civile e le norme collegate ai principi e ai valori della Costituzione. Nella diacronia delle fonti e nel divenire della realtà sociale, quindi, la famiglia, da società chiusa ed autoritaria, connotata dalla posizione di mera sudditanza della donna al marito, ha assunto sempre più la fisionomia di comunità aperta, nella quale la personalità dei singoli matura in modo naturale, talvolta sorretta, ma mai oppressa dallo Stato. La connotazione ha rafforzato la funzione primaria della famiglia, come luogo degli affetti, dei sentimenti e della solidarietà
