Autonomy or External Control? The Dilemma of the EU Accession to the ECHR after Opinion No. 2/13. The question of the compatibility of the Agreement for the EU accession to the ECHR with the EU Treaty had a negative response in Opinion No. 2/13. The ECJ considers the draft of the agreement for the accession contrary to the specificity of the EU Legal Order. In its Opinion, the Court analyses several questions, all of them concerning different legal aspects of the accession. This paper explains all the different issues considered by the ECJ. Hence, it emerges that the main question deals with the autonomy of the EU Legal Order and the rejection of an external judicial control by the European Court of Human Rights.
