Principles and general clauses are widely used in court and in literature argumentation also in administrative law; nonetheless, there is not, in Italy, a general theory of such rules in administrative law literature. The essay propose the idea that principles and general clauses – in court’s and academic argumentation and description of the case – are to be related to social rules – not legal – in force of the constitutional provision of sovereignty to the people instead of the State authority.
